If you do not agree to these Terms, you may not use Kind Quests.

1. About Kind Quests

Kind Quests is a community platform that connects people for real-life local adventures, casual meetups, and genuine help. Users can post "Quests" — plans, activities, or requests — and other users can browse, offer to join, and connect through the app's messaging features.

Kind Quests is a facilitation platform only. We are not a party to any agreement, exchange, or activity between users. We do not guarantee any meetup, service, or outcome.

2. User Eligibility

• You must be at least 18 years old to use Kind Quests.
• By creating an account, you represent and warrant that you are 18 or older.
• We collect and verify your date of birth during onboarding. Accounts that misrepresent age will be terminated.
• You must be a human — automated or bot accounts are prohibited.
• You must be legally able to enter into a binding contract in your jurisdiction.

3. Account Responsibilities

• You are responsible for all activity that occurs under your account.
• You must provide accurate and truthful information, including your real first name and a valid phone number.
• You must not share your account credentials or allow others to access your account.
• You must notify us immediately at support@kindquests.app if you suspect unauthorized access.
• One account per person. Creating multiple accounts to evade bans or restrictions is prohibited.

4. User Responsibilities — Acceptable Use

You agree to use Kind Quests only for lawful, personal purposes consistent with these Terms and our Community Guidelines.

You must not post quests, messages, or content that:

• Are illegal, harmful, threatening, violent, or deceptive.
• Involve or solicit sexual services, adult content, or explicit material.
• Constitute hate speech, harassment, discrimination, or bullying based on race, gender, religion, nationality, sexual orientation, disability, or any other characteristic.
• Request or involve the exchange of illegal drugs, controlled substances, or other contraband.
• Are scams or fraudulent schemes, including requests for money transfers, gift card payments, cryptocurrency, wire transfers, or advance fees.
• Impersonate any person, organization, or entity.
• Involve spam, unsolicited advertising, or commercial solicitation.
• Request professional medical, legal, financial, or therapeutic advice.
• Involve dangerous activities that could cause physical harm to you or others.
• Are emergency or crisis situations — please call emergency services (911 in the US) for urgent situations.
• Attempt to circumvent safety features, reporting tools, or moderation systems.
• Collect or harvest other users' personal information without their consent.

5. Real-Life Meetup Risks

• Always meet in public, well-lit places for initial interactions.
• Trust your instincts — it is always okay to cancel or leave if you feel unsafe.
• Do not share your home address, financial account details, or government ID with people you have just met through the app.
• Kind Quests does not conduct background checks on users.
• Kind Quests is not responsible for any harm, injury, loss, or damage arising from user interactions or real-life meetups.

6. User-Generated Content

You retain ownership of content you post on Kind Quests (quests, messages, photos, profile information). By posting content, you grant Kind Quests a non-exclusive, royalty-free, worldwide license to store, display, process, and use that content for the purpose of operating and improving the Service.

You represent and warrant that you have the right to post any content you submit, and that your content does not infringe the rights of any third party.

You are solely responsible for ensuring your content is accurate, appropriate, and compliant with these Terms.

7. Kind Quests' Rights to Moderate Content and Accounts

Kind Quests reserves the right, at our sole discretion, to:

• Remove any content that violates these Terms or our Community Guidelines.
• Suspend or permanently ban any account for violations of these Terms, at any time and without prior notice.
• Take action on reported content or users based on our moderation review process.
• Modify or discontinue features of the Service at any time.

We are not obligated to provide refunds, compensation, or advance notice when taking moderation actions. Appeals may be submitted to support@kindquests.app.

8. Optional Rewards and Payments

Some quests may include optional rewards (such as a coffee, meal, or small gift). Any reward exchange is solely between users — Kind Quests does not process payments, take a commission, or act as a payment intermediary.

Kind Quests is not responsible for disputes arising from reward arrangements. Requests for cash, wire transfers, cryptocurrency, or other financial instruments are prohibited and may result in account termination.

9. No Guarantee of Outcomes

Kind Quests does not guarantee that:

• Any quest will be fulfilled or any meetup will occur.
• Users will behave as expected or represent themselves accurately.
• The Service will be uninterrupted, error-free, or available at any particular time.
• Content on the platform is accurate, complete, or reliable.

10. Privacy

Your use of Kind Quests is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you also agree to the Privacy Policy.

11. Intellectual Property

The Kind Quests name, logo, design, and all original content created by Kind Quests are our intellectual property. You may not copy, reproduce, modify, or distribute our intellectual property without prior written permission.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be secure, error-free, or free from viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Kind Quests and its team, officers, employees, and affiliates shall not be liable for any:

• Indirect, incidental, special, punitive, or consequential damages.
• Damages arising from your use of or inability to use the Service.
• Damages arising from interactions with other users, including in-person meetups.
• Loss of data, profits, goodwill, or other intangible losses.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Kind Quests and its team from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

15. Account Termination

You may delete your account at any time from the app settings or by emailing support@kindquests.app.

We reserve the right to suspend or permanently terminate your account for any violation of these Terms, at our sole discretion, with or without notice.

Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) will survive.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you within the app. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction in Texas, and you consent to the personal jurisdiction of such courts.
